Hosting this site alone is enough to be prosecuted for whether the company complains to them personally or not. Sony could file charges tomorrow without ever contacting the site admin, and close romulation down. They can, you can't. And I'm not the one who's hosting the site, I'm not the one that should be expected to stand up to pressure. Removing roms because someone called in is like a drug dealer that stops selling weed because he was caught for it...but still sells coke and heroine because no one's told him to stop yet.

Which is what most companies do, but if they don't follow through, then they break out the lawsuit.

Nothing to make my mind up about...the only possibilities are there. Either: a) The admin is stupid enough to think that he can't be prosecuted if no one complains, so he's operating under the delusion that by removing content he is avoiding legal troubles down the road...a.k.a...a coward who's afraid to stand up to some legal pressure. or b) He is stupid enough to think the rest of his content is legal, because no one's complained yet. It's actually a fairly simple equation.

If you get slammed with a lawsuit with copyright issues, you will lose. It's a damn lose-lose situation.

Maybe you should look at the sites history, its been closed down before and come back. Would a coward do that?

So you're saying the site owner didn't know that to begin with? That he was stupid enough to host a site like this with the delusion that no one would ever find out about it, or have a problem with it? Or is he just going to keep removing content until there's nothing left but the forum?

Then why remove content? Why not just move the site? Or host the files on an external hosting service, thusly removing any liability and protecting the owner from prosecution? You know...like most of the movie sites do...and all the other big players who actually know what they're doing? There's really only two options here, either the admin's a coward, or an idiot. Seph has said from the beginning that if a company asks for their content to be removed from Romu's severs he would comply. I fail to see this "hypocricy", you could of atleast had the decency to spell the word properly, that you speak of.

This has been discussed before and I have explained why we remove content plenty of times, hell the blocked content even explains it somewhat. The short of it is that RomUlation is NOT about piracy, it's partly about allowing users to determine if a game (series) is worth paying money for. Nintendo does not provide demos, they do not provide any sort of comprehensive reviews for the majority of their titles, mostly the more mature or mainstream NDS games gets reviewed. RomUlation provided a way for people, especially parents to test out games, and for that we worked great for many years. Now we can't do that any more so we do the second best thing and provide screenshots etc. which, by the way, falls under fair-use.It's obvious you have some grand idea on how we should run things, but we've been doing this for a lot of years, we know the law and what we can and cannot do. Even if we use some external hosting service, torrents etc we'd still be breaking the law. Now you may call me a coward, but until you run a ROM site and refuse to remove content you can kindly go fuck yourself.
